01Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the ArchiFlow website, together with any content, forms, documentation, downloads, evaluation materials, learning content, and the chat assistant made available through it (collectively, the “Site”). The Site is operated by the entity that provides the ArchiFlow platform (“ArchiFlow,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the Site on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization. If you do not agree to these Terms, do not use the Site.
02Definitions
- “Platform” means the ArchiFlow software product and its installer, delivered separately under its own license or subscription agreement.
- “Content” means all text, graphics, logos, designs, code, video, documentation, and other materials made available on the Site.
- “Submission” means any information you send us through the Site, including demo requests, contact details, uploaded materials, and messages to the chat assistant.
- “Feedback” means any suggestions, ideas, or improvement requests you provide about the Site or the Platform.
- “Evaluation Materials” means any trial software, installer, sample data, datasheets, roadmap, or documentation we make available to you for assessment.
03Scope — Site vs. Platform
These Terms cover the informational Site only. Your use of the ArchiFlow Platform itself — including any on-premises or air-gapped deployment, proof of concept, evaluation, or subscription — is governed by a separate master agreement, license, order form, or data-processing addendum between you and ArchiFlow (the “Platform Agreement”).
Where a Platform Agreement conflicts with these Terms with respect to the Platform, the Platform Agreement controls. Nothing on the Site modifies, waives, or supplements a signed Platform Agreement.
04Eligibility & Acceptable Use
You must be at least the age of majority in your jurisdiction to use the Site, and you must use it for lawful business purposes. When using the Site, you agree not to:
- access, probe, or scan the Site or its infrastructure for vulnerabilities without our prior written authorization;
- attempt to gain unauthorized access to any system, account, or data, or interfere with, disrupt, or overload the Site or its infrastructure;
- scrape, harvest, or bulk-collect Content, or use automated means, bots, or scripted queries against the Site or its chat assistant;
- use the Site or chat assistant to train a competing model or product, or to benchmark the Platform for a competing offering;
- submit unlawful, infringing, defamatory, or malicious material, or content that is not yours to share; or
- misrepresent your identity or affiliation, or use the Site to transmit spam, malware, or other harmful code.
05Demo Access & Registration
Some parts of the Site — such as scheduling a demo, requesting evaluation access, or joining the Academy — may ask you to provide contact details or receive credentials. You agree to provide accurate, current information, to keep any credentials confidential, and to be responsible for activity under your access. We may refuse, suspend, or revoke access at our discretion, including where we suspect misuse.
06Evaluations, Betas & Early Access
We may offer trials, pilots, beta features, or early-access programs, including pre-release Academy content. These are provided for evaluation only, on an “as is” basis, may be changed or withdrawn at any time, and may not represent the final product. Any performance figures, timelines, or roadmap items shared during an evaluation are indicative, non-binding, and do not constitute a commitment to deliver any feature or functionality.
07Submissions & Feedback
When you request a demo, contact us, upload material, or interact with the chat assistant, you may provide a Submission. You retain ownership of your Submissions, but you grant us a worldwide, royalty-free license to use them for the purpose of responding to you, providing and improving the Site, and operating our business, consistent with our Privacy Policy. You represent that you have the rights necessary to share each Submission.
If you provide Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate it into our products and services without restriction or obligation to you. Any materials shared with you as part of an evaluation, demonstration, roadmap discussion, or investor or partner conversation are provided for your internal assessment only, may be confidential, and must not be disclosed or redistributed without our written permission.
08Downloads, Installer & Evaluation Software
If we make any software, installer, or Evaluation Materials available for download through the Site, we grant you a limited, revocable, non-exclusive, non-transferable license to use them solely for internal evaluation of ArchiFlow, subject to any accompanying license terms. You may not copy (except as strictly necessary to evaluate), modify, distribute, sublicense, rent, resell, reverse-engineer, decompile, or disassemble them, or remove any proprietary notices, except to the extent that restriction is prohibited by applicable law. All Evaluation Materials remain our property and must be destroyed at our request or at the end of the evaluation.
09Intellectual Property
The Site and all Content — including the ArchiFlow name, logos, product designs, copy, video, and underlying software — are owned by ArchiFlow or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own internal evaluation purposes. No other rights are granted, whether by implication, estoppel, or otherwise. You may not copy, modify, distribute, publicly display, sell, or create derivative works from the Content without our prior written consent.
10Third-Party Names & Trademarks
ArchiFlow is an independent, vendor-neutral platform. All product, service, and company names referenced on the Site — including the names of network hardware and software manufacturers — are the trademarks or registered trademarks of their respective owners and are used for identification and interoperability purposes only. Any such reference describes technical compatibility and does not constitute or imply any endorsement, sponsorship, certification, partnership, or affiliation between ArchiFlow and the trademark owner unless expressly stated in a signed agreement.
11Open-Source & Third-Party Components
The Platform builds on open-source and third-party components — including NetBox as a data foundation. Those components remain the property of their respective authors and are licensed under their own terms, which govern your use of them and, in case of conflict, take precedence over these Terms with respect to that component. Nothing here grants you rights in any third-party or open-source software beyond those granted by the applicable upstream license.
12Export Controls, Sanctions & Government Use
The Site and any Evaluation Materials may be subject to export-control and sanctions laws. You represent that you are not located in, and will not access or export the materials to, any country or party subject to a comprehensive embargo or restricted-party designation, and that you will comply with all applicable export, re-export, and import laws. Because ArchiFlow is frequently deployed in regulated, defense, government, and critical-infrastructure environments, you are responsible for ensuring that your use — including any air-gapped deployment — complies with the laws and authorizations applicable to you.
13Confidentiality
Non-public information we share with you through the Site or in related discussions — including pricing, roadmap, security documentation, architecture details, and investor or partner materials — is our confidential information. You agree to use it only to evaluate a possible or existing relationship with ArchiFlow, to protect it with at least reasonable care, and not to disclose it to third parties without our prior written consent, except where a signed non-disclosure agreement provides otherwise.
14Chat Assistant & Automated Responses
The Site may offer an AI-assisted chat feature. Its responses are generated to help you learn about ArchiFlow and may be incomplete or inaccurate. They are provided “as is,” do not constitute professional, technical, legal, or contractual advice, and should not be relied upon as a binding statement of product capability, security posture, pricing, or terms. Do not submit confidential information, credentials, or sensitive personal data to the chat assistant. For authoritative information, contact our team directly.
15Third-Party Links & Services
The Site may link to or integrate third-party websites, resources, or services (for example, scheduling, video, or analytics tools). We do not control and are not responsible for the content, policies, or practices of any third party. Accessing linked resources is at your own risk and subject to their terms and privacy policies.
16Copyright Complaints
We respect intellectual-property rights. If you believe Content on the Site infringes your copyright, contact us at agent@archiflow.space with enough detail to identify the work, the allegedly infringing material and its location, your contact information, and a statement of good-faith belief. We will review and respond appropriately, which may include removing the material.
17Disclaimer of Warranties
THE SITE, ITS CONTENT, AND ANY EVALUATION MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
18Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHIFLOW AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19Indemnification
You agree to indemnify and hold harmless ArchiFlow and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or Evaluation Materials, your violation of these Terms or applicable law, or your infringement of any third-party right.
20Term, Suspension & Termination
These Terms apply while you use the Site. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Site, its users, or our rights. Provisions that by their nature should survive — including Intellectual Property, Feedback, Confidentiality, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — survive termination.
21Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor conditions, governmental action, internet or utility failures, or third-party service outages.
22Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which the ArchiFlow operating entity is established, without regard to its conflict-of-laws provisions. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to their jurisdiction and venue. Nothing in this section limits any mandatory consumer-protection rights available to you under applicable local law.
23General
These Terms, together with the Privacy Policy and any Platform Agreement, are the entire agreement between you and ArchiFlow regarding the Site. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We may provide notices to you through the Site or the contact details you supply.
24Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may be highlighted on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
